Terms of Service

These Terms of Service ("Terms") are an agreement between you and Eduardo Airaudo, an individual operating the CheckLeaked service from Uruguay ("CheckLeaked", "we", "us"). They govern your use of whatsapp.checkleaked.cc, our APIs (whether accessed directly or through marketplaces such as RapidAPI or Apify), our bots, SDKs, bulk tools and datasets (together, the "Service").
By creating an account, subscribing to a plan, obtaining an API key or otherwise using the Service, you accept these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you accept these Terms for that organization and confirm that you are authorized to do so. If you do not agree, do not use the Service.
1. Eligibility and accounts
- You must be at least 18 years old and legally able to enter into this agreement.
- You must provide accurate account information and keep your credentials and API keys confidential. You are responsible for all activity under your account and keys.
- You may not create accounts to evade a suspension, a rate limit or a quota, and you may not share, resell or publish API keys.
2. What the Service does
Given a phone number, the Service returns information associated with that number. Depending on the endpoint, plan and options you choose, this can include:
- whether the number is registered on WhatsApp, and the profile information its owner has made visible under their WhatsApp privacy settings (for example profile picture, "about" text and business profile details), including earlier versions we observed over time;
- information from other public or third-party sources, such as Telegram presence, search engine results, phone-number metadata, caller-identification and spam lists, and business reputation data;
- information associated with the number in previously published data breaches or leaked datasets (for example the 2019 Facebook scraping dataset) and in breach-indexing services;
- AI-generated estimates derived from profile pictures (approximate age range, gender presentation, apparent emotion and apparent ethnicity) and AI-generated summaries of the available data;
- search, filtering, bulk checks, exports and downloadable copies of our database, on the plans that include them.
Lookups do not send any message or notification to the number being looked up. Data can be incomplete, outdated or wrong, and fields are empty when the owner has restricted them.

3. Permitted purposes
You may use the Service only for legitimate purposes for which you have a lawful basis, such as:
- verifying phone numbers that were provided to you, for example during customer onboarding, identity or know-your-customer checks, or to keep your own customer records accurate;
- preventing, detecting and investigating fraud, scams, impersonation and account abuse;
- authorized security research, threat intelligence and investigations carried out by or for organizations entitled to perform them;
- checking what information is visible about your own phone number.
4. Your data protection obligations
Personal data you obtain through the Service is under your control and responsibility. For that data you act as an independent controller (or the equivalent role under your local law). Each time you use the Service you represent and warrant that:
- you have a valid lawful basis under all data protection laws that apply to you and to the people concerned — including, where applicable, the EU and UK GDPR, the California Consumer Privacy Act, Brazil's LGPD and Uruguay's Law 18.331 — for every number you look up and for everything you do with the results;
- where applicable law requires the consent of the person concerned, you have obtained that consent before the lookup, in a form you can demonstrate, and you will stop processing their data if they withdraw it;
- you have given the people whose numbers you process the privacy information required by law;
- you will keep records showing the lawful basis (and, where required, the consent) for your lookups and will provide them to us within 10 business days if we ask, for example when we investigate a complaint or when a platform we distribute through requires it;
- you will honor the rights of the people concerned, including requests to access, correct or delete their data and objections to processing;
- you will keep data obtained through the Service secure, limit access to people who need it, and delete it once it is no longer needed for the purpose you obtained it for.
We do not obtain consent from the people whose numbers are looked up on your behalf, and nothing in the Service gives you permission to contact, market to or process data about anyone.
5. Prohibited uses
You must not use the Service, or any data obtained from it, to:
- stalk, harass, threaten, intimidate, dox or shame anyone, or to locate, follow or monitor a person, including a current or former partner, family member or employee, without their knowledge and a lawful basis;
- identify or build profiles of private individuals without a lawful basis;
- make or support decisions about a person's eligibility for employment, credit, insurance, housing, education, benefits or any similar purpose. We are not a consumer reporting agency, and the Service must not be used as a consumer report under the U.S. Fair Credit Reporting Act or similar laws;
- discriminate against anyone, or to infer, target, filter or segment people by ethnicity, race, religion, health, sexual orientation, political opinion or any other sensitive characteristic;
- send unsolicited messages, calls or marketing, or otherwise breach anti-spam, telemarketing or electronic-communications laws (such as the ePrivacy rules or the U.S. Telephone Consumer Protection Act);
- access, or attempt to access, any account or system, test or use credentials, or commit fraud, identity theft or social engineering;
- target children or process data you know belongs to a child;
- sell, license, publish or otherwise redistribute data obtained from the Service, or use it to build or improve a competing database, unless we agree in writing;
- circumvent rate limits, quotas, security measures or opt-outs, or use the Service in breach of any applicable law.
6. Breach and leaked-data results
Results derived from data breaches or leaked datasets may only be used for security, fraud prevention and exposure assessment. You must not use them to contact the people concerned for any other purpose, to access accounts, or to combine them with other data to identify or profile individuals.
7. AI-generated estimates and reports
Age, gender, emotion and ethnicity estimates and AI reports are produced automatically, are frequently wrong, and do not verify anyone's identity or characteristics. You must not rely on them to make any decision about a person, and you must not use them for any of the purposes in section 5.
8. Opt-outs and deletion requests
The owner of a phone number can ask us to delete the data we store about it and to block future lookups at whatsapp.checkleaked.cc/opt-out. When we honor such a request, lookups of that number stop returning data.
If we notify you that a number has been opted out or that a person has asked for deletion, you must delete the data you obtained about that number through the Service within 30 days and must not look it up again through other means to recreate it.
9. Bulk tools, exports and datasets
Exports and dataset copies are licensed to you, not sold. They are subject to all of these Terms, may only be used by you for the permitted purposes in section 3, must be stored securely, and must be deleted when your plan ends or when we ask you to delete specific records. You are responsible for any further processing of those copies.
10. API keys, rate limits and availability
- Plans include quotas and rate limits that we may enforce technically. Requests above your plan may be rejected or billed as described in the plan.
- We may change, add or remove endpoints, fields, data sources and features, including to meet legal or platform requirements.
- We aim for high availability but do not guarantee uninterrupted service.
11. Fees and payments
Paid plans are charged in advance through the provider shown at checkout (for example RapidAPI, Apify, PayPal or a cryptocurrency processor), and that provider's terms also apply to the payment. Refund requests can be sent to [email protected] and are reviewed case by case. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
12. Monitoring, suspension and termination
We monitor usage to protect the people whose data is in the Service and to enforce these Terms. We may suspend or terminate access, with or without notice and without refund, if we reasonably believe you have breached these Terms or applicable law, if you fail to provide lawful-basis records we request, or if required by law or by a platform we distribute through. We may report unlawful activity and cooperate with competent authorities. On termination you must stop using the Service and delete data obtained from it, except where the law requires you to keep it.
13. Intellectual property
The Service, its software and our compilation of data are protected by intellectual property laws and remain ours or our licensors'. You receive a limited, non-exclusive, non-transferable right to use the Service under these Terms. Third-party names and trademarks, including WhatsApp, Telegram and Facebook, belong to their owners and are used only to describe compatibility or data sources. WhatsApp is a trademark of WhatsApp LLC. CheckLeaked is an independent service and is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc.
14. Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement. Information returned by the Service is not verified identity information.
15. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, and our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. These limits do not apply where liability cannot be limited by law, including for intent or gross negligence.
16. Indemnity
You will defend and indemnify us against claims, fines, damages and costs (including reasonable legal fees) arising from your use of the Service or of data obtained from it in breach of these Terms or of applicable law, including claims by the people whose data you processed and by data protection authorities.
17. Changes to these Terms
We may update these Terms. We will change the date and version at the top, and for material changes we will notify account holders by email or on the website before they take effect. If you keep using the Service after changes take effect, the new Terms apply; if you do not agree, stop using the Service. Accounts record which version of the Terms was accepted.
18. Governing law and disputes
These Terms are governed by the laws of the Oriental Republic of Uruguay, without regard to conflict-of-law rules. The courts of Montevideo, Uruguay, have jurisdiction over disputes arising from these Terms, except that if you are a consumer, you keep the protection of mandatory laws and courts of your country of residence.
19. General
- These Terms, the Privacy Policy and any plan-specific terms shown at purchase are the entire agreement between you and us about the Service.
- If you access the Service through a marketplace such as RapidAPI or Apify, that marketplace's terms also apply; if they conflict with these Terms on how you may use our data, the stricter rule applies.
- If a provision is found unenforceable, the rest remains in effect and the provision is applied as far as the law allows.
- Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent.
- These Terms are written in English. If we provide a translation, the English version prevails.
